1.Introduction

JobsOnDemand is a collection of Platform and Services subject to the Aptus Technologies Terms of Service and by using JobsOnDemand you acknowledge that you have read and understood these Terms of Use, our Privacy Policy and agree to be bound by them. If you do not accept or wish to be bound by these Terms of Use, then you may not access or use the Platform. Aptus reserves the right to make amendments to these Terms of Use and our Privacy Policy without notice. It is your responsibility to periodically review these Terms of Use and our Privacy Policy.

2. Definitions


“Platform” refers to any software, application, website, web app, or portal owned and operated by Aptus Technologies“Services” refers to the matching of users with third parties as facilitated through the Platform and any other additional assistance, offering, or support provided by Aptus to ensure the smooth facilitation of the matching“Personal Data” refers to any information which can be used to identify you or from which you are identifiable including but not limited to information such as your name, gender, age, date of birth, contact information, residential address, bank details, and picture.

3. Representations and Warranties


You represent and warrant that:

3.1. You have the authority and legal capacity to enter into and perform legally binding contracts under the applicable laws, and you are at least eighteen (18) years old if an individual or a duly incorporated entity existing validly under the laws of incorporation if you are a corporate entity.

3.2. Your use of our Platform will comply with all applicable laws and regulations.

3.3. You have provided only true and accurate information to us.

3.4. Any content uploaded by you to the Platform does not violate or infringe another party’s rights of publicity, privacy, copyright, trademark, or any other intellectual property rights.

4. Limitation of Liability

As a Platform, Aptus does not guarantee or represent that:

4.1. The usage of JobsOnDemand or our Services will result in successful jobs, interviews, or recruitment;

4.2. Any advice, content, or material available on the Platform or provided by Aptus whether through our Services or otherwise is accurate or useful;

4.3. A job applicant is competent or truthful;

4.4. A job post or job poster is truthful and genuine;

4.5. The Platform shall be free of faults, errors, bugs, viruses or serve uninterruptedly;

4.6. The material provided by third-party users to the Platform is the responsibility of Aptus. Aptus has no control over such material and shall not be held responsible for any violation or dispute that may arise from such material.

4.7. Any dispute or violation arising from the transactions held between third-party users on the Platform is the responsibility of Aptus.

Furthermore:



4.8. Aptus shall not be liable for any of the following losses or damage:
- Loss of data (including Personal Data);
- Loss of revenue;
- Loss of business and opportunity;
- Damage to reputation;
- Indirect damages arising from the use of Platform

4.9. Aptus shall not be held liable for any failure of any kind from causes beyond our control, including but not limited to, power failure, network failure, device/computer, server, and infrastructure failure, fires, floods, Act of God, war, government actions and non-performance of third parties.

4.10. Aptus and its affiliates, associated companies, employees, directors, partners, shareholders, advisors, and other related parties shall not be held liable in the event for damage of any kind suffered by you, whether directly or indirectly, arising from your use or inability to use the Platform and Services.

5. Intellectual Property



5.1. All content uploaded by you, belonging to Aptus, or made available on the Platform by any third party shall be the intellectual property of Aptus and is protected accordingly by copyright and intellectual property laws.

5.2. When submitting any contribution to the Platform, you are granting Aptus a perpetual, royalty-free, exclusive right and license to use this contribution freely and the right to remove any of your material without your consent as we see fit.

6. Termination


Aptus may, without notice and at our sole discretion, restrict or terminate any user account and refuse or limit access to our Platform or Services.

7. Confidentiality


All information provided by Aptus shall be deemed confidential and shall be disclosed only in accordance with the discretion of Aptus.

8. Governing Law


These Terms of Use are governed by and enforced in accordance with the laws of the Republic of Singapore.

9. Entire Agreement


These Terms of Use and other materials referenced herein are the entire agreement between you and Aptus in relation to your use of our Platform and the provision of our Services.

10. Disputes


By accepting these Terms of Use you agree that any dispute or claim arising out of, or in connection with, this Terms of Use shall be submitted to the non-exclusive jurisdiction of the courts of the Republic of Singapore.

11. Violation


Aptus reserves the right to address any violations to the Terms of Service as criminal and civil liabilities as provided by the Computer Misuse Act (Cap. 50A), Spam Control Act (Cap. 331A) and the Personal Data Protect Act.
